Fortunately mine wasn’t bent out of shape beyond the bumper…I’d had it back ten mins from a Porsche Centre after a service when I had my incident…I was stationary in traffic…anyway here’s what’s underneath the rear bumper if anyone cares.

So today I walked down the road looking for Ring doorbell cameras at the scene where numpty rear ended my car, the hope was to find footage of my car going past and then his van going past to disprove his claim that I reversed out a driveway.

Struck gold.. found a house with a proper CCTV camera stuck on it pointing directly at the scene. Was it connected? How long did it keep footage for?...I knocked on the door... no reply.

Went back a couple of hours later...still no reply, nuts.

Went back a 3rd time at 7-30 and a lovely old couple, must be in their 70s/80s who said yes it works but they have never played it back. Fiddled around and the power cable was not connected 😬 She said it would have only been disconnected a few days ago as they were trying to untangle all the wires. Got it powered up and I googled and you tubed how to do the playback and BINGO!

A lovely clear film of me coming up the road at or below the 20mph speed limit and his van closing rapidly and braking hard and then hitting my car.

I have already emailed it to my insurance co, the only thing is I have not got the date and time stamp showing as I filmed it off their tv but I may go back tomorrow and do another film of it with that showing just in case.

That is him screwed for sure now!

That raises the question "is it fraud if he is trying to NOT make a claim" or is the fraud related to his false statement or too the money?

I'm sure someone will be along shortly.

Good luck with the claim and well done on the Ring doorbell thing, further evidence there IS intelligent life on this forum despite myself and a few others doing our best to bring the IQ average down.

My previous employment does help when it comes to things like that though.

You should read my statement... its exactly like I am still job quoting weather conditions, traffic levels and use of northbound, westbound... the only thing missing from the statement was the phrase "on duty in a marked Police car in full uniform" 🤣

 

As far as lying to the insurance co goes, I am not sure. Bit different from what I used to deal with. I am not sure his insurers would care as it would lesson the cost to them if he had got away with it. I have a very low opinion of all insurance companies though.

So the next fight will be getting his insurance company to pay the correct amount per hour for the work to be done at my choice of repairer.

Perhaps a negotiation point is that their policy holder was clearly lying and they had failed to gather and review information on witnesses before trying to contest the claim.  Also with the video evidence go to a claims company.  They should you use your preferred repairer and they will have the argument with the at fault party.

Finally got authority for the car to go to my choice of repairers! That in itself was a fight but the car is going in next Wednesday for the work to be done.

Not sure if it means that Aviva have finally accepted their client is a liar who suffers from road rage but we will see.

A friend who is a specialist in this field has reviewed the video and from using 2 static points and the basis that I know my speed was just under 20mph between the points, he estimated the 3rd party drivers speed to comfortably be in excess of 45mph in the 20mph limit before he started to brake.

Car went in today. It was the 3rd party insurers who gave the go ahead so I guess they have reviewed the video evidence!

Done a deal to get the bonnet and front bumper resprayed at the same time and have the wheels refurbished.

 

Loan car from Enterprise is a BMW 330i. Way too much tech to try and work out on it

Just reading this lot for the first time. Could be that the van driver is not the owner of the van, rather an employee and is trying to make the incident look like not his fault to avoid being sacked. Just a thought. The insurers don't give a monkey about anything as long as they don't have to pay out and will try anything to wriggle out of coughing up. Well done for getting the footage.

Thanks for taking care of the extras.  Could off set the known accident repair at sale time. 😉

That's a sensible move, it should considerably increase the second hand value of the car ;)

Nah it was his van... he just further proved what a pr!ck he was by trying to get out of the concequences of his actions!

 

Forgot to mention, when I got to the garage the guy they get in to remove little car park dents was there. Her recognised me from doing the Alfa Spider and said hello while I was waiting. I showed him the tiny car park dent in the drivers door of my car. He went over with some metal rod/pole and 5 mins later the dent was gone!

Car picked up this morning and looks fab. They did a great job of respraying the bonnet and front bumper while it was there, and I got the rear wheels refurbished as there was a few marks on them.

Insurance company are about as much use as a chocolate fireguard. I sent them the CCTV footage on 14th April which proved the 3rd party lied on his statement, I then had to chase them up on 4th May and they still had not even sent it to Aviva (the 3rd party insurer) but they sent it on to them then. I sent another email to the lady dealing with it on 21st May asking for an update, and did not even get a reply to that one. Sent another email on 2nd June asking what was going on and then got this back on 6th June...

 

"At this time we are still waiting for Aviva to reply

 I have sent them a further chase regarding the footage and also sent stills of the footage over to see if we can prompt a reply.

Appreciate your patience during this investigation and I will return to you as soon as I can

Kind Regards"

 

I can't believe how cr*p they are, its like they have no interest in getting it sorted and only do anything after my 3rd chase up. They have 2 witnesses and have had clear CCTV of the whole incident since 14th April and still have not got it sorted.

At least I did not have to pay any excess to pick my car up while they are sorting it out as they are "confident the 3rd party will be found at fault". Given the above, even a 12 yr old should be able to prove that.

 

Anyway, a few pics after picking it up... now I have to get the Nattys Wax back out and give it a few coats of protection

Good to see it sorted - although state of those exhaust tips is a little embarrassing 😜

i heard a rumour before that insurance companies don’t make much effort of the claim is less than £10k as it costs them so much to chase it down - which seems blooming ridiculous if it’s true

The insurance company were very tight on replacement parts, I did want new tips but they said no.... but then, The cost of the loan BMW was £100 a day so thats going to be over £3k alone so priorities and all that.

 

I just don't want to be in the situation come renewal time when they say theres a claim against me because of their inabilities.

 

Just took the car for a drive for no reason and really loved it, even got a chance to test the suspension on a few corners... what a thing!
